  • PatriotHosting.io Services: Refers to the web hosting, web design, and digital marketing services offered through www.patriothosting.io, including but not limited to shared hosting, VPS hosting, dedicated servers, and related support services.
  • Patriot Digital Services: Refers to the digital marketing and web design services offered through https://patriot.digital/, including but not limited to SEO, PPC, social media marketing, and related consultancy services.

User Roles:

  • Client: An individual or entity that has entered into an agreement with Patriot Digital Services, LLC to receive services.
  • User: Any person who accesses or uses the services provided by PatriotHosting.io or Patriot Digital.

Technical Terms:

  • Bandwidth: The amount of data that can be transferred over an internet connection in a given period.
  • Uptime: The amount of time that the services are operational and accessible.
  • Content Management System (CMS): A software application used to create, manage, and modify digital content.

Prohibited Activities:

  • Spam: Unsolicited and unauthorized electronic messages sent in bulk.
  • Malware: Software designed to disrupt, damage, or gain unauthorized access to computer systems.
  • Phishing: Fraudulent attempts to obtain sensitive information by disguising as a trustworthy entity.
  • Illegal Activities: Hosting, distributing, or linking to any material that violates local, national, or international laws. This includes copyrighted content without proper authorization, counterfeit goods, and any form of illegal software.

  • Adult Content: Hosting or distributing pornographic or explicit adult material.
  • Gambling: Operating or promoting online gambling activities without proper licensing.
  • Hate Speech and Harassment: Content or activities that promote violence, hatred, or harassment against individuals or groups.
  • Terrorism: Hosting or supporting content related to terrorist activities or organizations.
  • Intellectual Property Violations: Unauthorized use or distribution of copyrighted material, trademarks, or other intellectual property.
  • Proxy Scripts and Anonymous Browsers: Running proxy scripts, anonymous browsing services, or other tools designed to anonymize traffic.
  • Storage of Backups: Using web hosting space primarily for the storage of backup files, unrelated to the website’s primary function.
  • File Sharing and Streaming: Hosting platforms for file sharing, peer-to-peer networks, or streaming services without proper licensing or authorization.

Payment and Billing Terms:

  • Invoice: A statement of charges for services provided.
  • Subscription Fee: The recurring charge for the continued use of services.
  • Billing Cycle: The regular interval at which a client is billed for services.

Intellectual Property:

  • Content: All text, graphics, images, audio, video, and other material provided by users or by Patriot Digital Services, LLC.
  • Trademarks: Any registered or unregistered trademarks owned by Patriot Digital Services, LLC.
  • Copyright: Legal rights protecting the original works of authorship created by users or by Patriot Digital Services, LLC.

Service Levels:

  • Support Ticket: A record of a service request or issue submitted by a client for assistance.
  • Service Level Agreement (SLA): A commitment to maintain a certain level of service performance.

3. Services Provided

3.1 PatriotHosting.io & Patriot Digital Services: PatriotHosting.io offers a comprehensive range of web hosting, web design, and digital marketing services tailored to meet the needs of businesses and individuals. Our services include:

  • Web Hosting:
      • Shared Hosting: Affordable hosting solutions ideal for small to medium-sized websites.

    • Domain Registration: Easy domain registration and management services.
    • Additional Features: SSL certificates, email hosting, daily backups, and enhanced security features.
    • Website Builders: Integration with popular content management systems such as WordPress for easy website creation and management.
  • Web Design:
    • Custom Website Design: Tailored website designs that reflect your brand and meet your business needs.
    • E-commerce Site Development: Comprehensive e-commerce solutions for online stores.
    • UX/UI Design: User experience and user interface design to enhance usability and engagement.
    • Free and Premium Plugins: Web design services include free unique plugins that Patriot Digital Services, LLC has acquired licenses for, enhancing your website’s functionality. If you choose to no longer be a customer of Patriot Digital Services, LLC or move your hosting provider elsewhere, you are responsible for acquiring these licenses independently. This may result in your site breaking or no longer being able to receive updates from these premium plugins.
    • Additional Premium Plugins: In some cases, you may need to purchase additional premium plugins, which may add to the original package cost. Examples include booking plugins, e-commerce plugins, contact forms plugins, advanced SEO plugins, membership management plugins, and advanced analytics plugins. These will be quoted out before the web design process begins, ensuring you are fully aware of any potential additional charges.
    • API Access: In certain cases, you might need to purchase access to APIs for services such as Google Maps, real estate listings, payment gateways, and social media integrations. These requirements will be discussed and quoted during the planning phase of your web design project.
    • Server Compatiability: Users do not have to be a web hosting customer of PatriotHosting.io to utilize our web design services; however, if not hosted by PatriotHosting.io, certain server compatibilities are required. If your current hosting provider is not compatible, you may need to find another hosting provider, or we may have to terminate our web design service.
  • Digital Marketing:
    • SEO (Search Engine Optimization): Strategies to improve your website’s visibility and ranking on search engines.
    • PPC (Pay-Per-Click) Advertising: Targeted advertising campaigns to drive traffic and conversions.
    • Social Media Marketing: Management and promotion of your brand on social media platforms.
    • Content Marketing: Creation and distribution of valuable content to attract and engage your audience.
    • Consulting Services:
      • Digital Strategy Consulting: Expert guidance and strategies to maximize your digital marketing efforts.
      • Web Design Consulting: Advice and planning for effective website design and development

    • Results: While we strive to achieve the best possible results from our digital marketing campaigns, we cannot guarantee success due to factors such as industry niche and competition.

    • External Web Hosting: You don’t have to be a web hosting customer of PatriotHosting.io to utilize our digital marketing campaigns.

    • Customer Site Access: Some of our digital marketing services require access to your web hosting to make necessary changes to your website. Customers agree to provide all necessary access to their web hosting provider, CMS, and FTP.

    • Restricted Sites: We do not work on the following types of sites: adult content, gambling, hate speech and harassment, terrorism, and other unlawful activities.

3.2 Support Services: Patriot Digital Services, LLC is committed to providing exceptional support to our clients. Our support services include:

  • 24/7 Customer Support: Available around the clock to assist with any issues or questions.
  • Live Chat and Email Support: Responsive support through live chat and email.
  • Service Guarantees: Commitment to high service availability and quick response times to support requests.

3.3 Service Availability: Our services are available to clients United States, with certain restrictions and limitations based on local laws and regulations. We strive to offer consistent and reliable services, regardless of your location.

4. User Responsibilities

4.1 Compliance with Laws and Regulations:

  • Users agree to comply with all local, national, and international laws and regulations applicable to their use of Patriot Digital Services, LLC’s services. This includes, but is not limited to, laws regarding data privacy, intellectual property, and online conduct.

4.2 Accurate Information Provision:

  • Users must provide accurate and complete information when registering for and using our services. This includes personal details, payment information, and any other data required to facilitate service provision.

4.3 Account Security:

  • Users are responsible for maintaining the confidentiality and security of their account credentials. This includes safeguarding passwords and other authentication methods. Users must immediately notify Patriot Digital Services, LLC of any unauthorized use of their account or any other breach of security.

Misuse of services, including any activities that disrupt or harm our systems or other users, is strictly prohibited.

4.7 Prohibited Activities:

  • Users are prohibited from engaging in any activities outlined in Section 2 (Definitions) under Prohibited Activities. This includes, but is not limited to, illegal activities, resource abuse, adult content, gambling, hate speech, harassment, terrorism, intellectual property violations, proxy scripts, anonymous browsing, storage of backups, and unauthorized file sharing and streaming.

4.8 Cooperation with Investigations:

  • Users agree to cooperate with any investigations conducted by Patriot Digital Services, LLC regarding suspected violations of these Terms of Service. This may include providing access to account information and content as required.

4.9 Payment Obligations:

  • Users are responsible for timely payment of all fees and charges associated with the use of our services. This includes understanding and adhering to the billing terms outlined in Section 7 (Billing and Payment).

4.10 Service Suspension and Termination:

  • Patriot Digital Services, LLC reserves the right to suspend or terminate user accounts in cases of non-compliance with these Terms of Service. Users will be notified of such actions and provided with an opportunity to rectify the situation if applicable.

By using the services of Patriot Digital Services, LLC, users acknowledge and agree to these responsibilities. Failure to adhere to these responsibilities may result in the suspension or termination of services and/or legal action. 5. Account Registration and Security

5.1 Account Registration:

  • To access and use the services provided by Patriot Digital Services, LLC, users must create an account through our designated platform, managed via the my.patriothosting.io portal. Users must provide accurate and complete information during the registration process, including a valid email address and other necessary details.

5.2 Account Activation:

  • Once the registration process is complete, users will receive an email confirmation with instructions to activate their account. Users must follow the instructions to activate their account and gain access to our services.

5.3 Account Management:

  • Users can manage their account details, billing information, and service subscriptions through the my.patriothosting.io portal. It is the user’s responsibility to keep their account information up to date and accurate at all times.

5.4 Account Security:

  • Users are responsible for maintaining the security of their account credentials, including usernames, passwords, and any other authentication methods. Users must not share their login information with others and should take appropriate measures to safeguard their accounts.
  • Users must immediately notify Patriot Digital Services, LLC of any unauthorized use of their account or any other security breach. Failure to do so may result in the suspension or termination of the account.

5.5 Backup Responsibility:

  • While Patriot Digital Services, LLC implements various security measures to protect user data, users are ultimately responsible for maintaining backups of their website and related data. Users must ensure that they have regular backups stored on a separate platform to prevent data loss in case their account is compromised or hacked.
  • Patriot Digital Services, LLC is not liable for any loss of data or inability to restore data due to insufficient backups on the user’s part. Users are strongly encouraged to use reliable backup solutions to safeguard their information.

5.6 Use of my.patriothosting.io Portal:

  • The my.patriothosting.io portal is used for account management, billing, and shopping cart functions. Users must comply with all terms and policies when using these features. Any misuse of the portal may result in account suspension or termination.

5.7 Password Management:

  • Users should use strong, unique passwords for their accounts and change them regularly. It is recommended to use a combination of letters, numbers, and special characters to enhance password security.
  • Patriot Digital Services, LLC provides tools and recommendations for secure password management but is not responsible for any breaches resulting from weak or compromised passwords.

5.8 Multi-Factor Authentication (MFA):

  • Patriot Digital Services, LLC strives to provide high levels of service availability for all our offerings through PatriotHosting.io and Patriot Digital. We aim to maintain an uptime of 99.9% for our web hosting services, barring scheduled maintenance and unforeseen events beyond our control.

6.2 Scheduled Maintenance:

  • To ensure optimal performance and security, we may perform scheduled maintenance on our systems. Users will be notified in advance of any maintenance activities that may cause service interruptions. We strive to schedule maintenance during off-peak hours to minimize impact on users.

6.3 Unscheduled Downtime:

  • While we endeavor to provide continuous service, unforeseen issues such as hardware failures, network disruptions, or other emergencies may cause unscheduled downtime. We will work diligently to resolve such issues as quickly as possible and communicate status updates to affected users.

6.4 Performance Standards:

  • We are committed to delivering high-performance services. This includes fast server response times, reliable network connections, and efficient resource management. Users can expect their websites and applications to perform optimally under normal operating conditions.

6.5 Technical Support:

  • Patriot Digital Services, LLC provides technical support to assist users with any issues or questions related to our services. Our support team is available 24/7 through live chat, email, and support tickets submitted via the my.patriothosting.io portal. We aim to respond to all support requests promptly and provide effective resolutions.

6.6 Backup Responsibility:

  • Users are responsible for maintaining backups of their websites and related data on a different platform. While we implement various security measures to protect user data, it is crucial for users to ensure they have regular and reliable backups. This helps prevent data loss in case of account compromises, hacking incidents, or other unforeseen issues.
  • Patriot Digital Services, LLC is not liable for any loss of data or inability to restore data due to insufficient backups on the user’s part. Users are strongly encouraged to use external backup solutions to safeguard their information.

6.7 Service Limitations:

  • Our services are available United States; however, there may be limitations or restrictions based on local laws and regulations. Users are responsible for ensuring their use of our services complies with applicable laws in their region.
  • We reserve the right to restrict or terminate services to users who violate our Terms of Service or engage in prohibited activities.

6.8 Service Level Agreement (SLA):

  • For certain services, we offer a Service Level Agreement (SLA) that outlines our commitment to maintaining specific performance and availability standards. Users covered by an SLA will receive additional guarantees and compensation for service interruptions as specified in the agreement.

6.9 Monitoring and Optimization:

7. Billing and Payment

7.1 Payment Methods:

  • Patriot Digital Services, LLC accepts various payment methods for our services, including major credit cards, debit cards, and PayPal. Users can manage their payment methods through the my.patriothosting.io portal.

7.2 Billing Cycle:

  • Our services are billed on a recurring basis, either monthly or annually, depending on the selected service plan. The billing cycle begins on the date of service activation and recurs on the same date each month or year.

7.3 Invoices:

  • Users will receive an invoice for each billing cycle, detailing the charges for the upcoming period. Invoices are available for review and download in the my.patriothosting.io portal. Users are responsible for ensuring timely payment of all invoices.

7.4 Payment Due Date:

  • Payment for services is due on the invoice date. Failure to pay by the due date may result in suspension or termination of services. Users are encouraged to set up automatic payments to avoid missed payments and service interruptions.

7.5 Late Payments:

  • Accounts that are not paid by the due date may be subject to late fees. If payment is not received within a specified period after the due date, services may be suspended or terminated. Reinstatement of services after suspension will require full payment of outstanding balances and may incur additional reactivation fees.

7.6 Subscription Fee:

  • Users subscribing to our services will be charged a recurring subscription fee, as specified in their selected service plan. The subscription fee covers the use of services for the upcoming billing cycle and is non-refundable except as outlined in our refund policy.

7.7 Refund Policy:

  • Refunds may be granted under certain conditions, as detailed in our refund policy. Users seeking a refund must submit a request through the my.patriothosting.io portal. Refund eligibility and processing times vary depending on the service and circumstances of the request.

7.8 Changes to Service Plans:

  • Users may upgrade or downgrade their service plans through the my.patriothosting.io portal. Changes to service plans will be prorated based on the remaining period of the current billing cycle. Additional charges or credits resulting from plan changes will be applied to the next billing cycle.

7.9 Taxes:

  • Users are responsible for any applicable taxes, including sales tax, value-added tax (VAT), or other taxes required by law. Taxes will be added to the invoice total as required by the relevant taxing authorities.

7.10 Disputed Charges:

  • If a user believes there is an error in their billing, they must contact our billing department within 30 days of the invoice date. Patriot Digital Services, LLC will investigate the disputed charges and work with the user to resolve any issues. Failure to dispute charges within this period will constitute acceptance of the charges.

7.11 Account Termination:

  • Users may terminate their account and services through the my.patriothosting.io portal. Termination requests must be submitted before the end of the current billing cycle to avoid being charged for the next cycle. No refunds will be provided for partial billing cycles.

7.12 Automatic Renewal:

  • Unless otherwise specified, all services are set to automatically renew at the end of each billing cycle. Users who do not wish to renew their services must disable automatic renewal through the my.patriothosting.io portal before the end of the current billing cycle.

8. Refund Policy

8.1 Monthly Billing Cycle:

  • There are no refunds for services billed on a monthly cycle. Once a monthly billing cycle has started, the user is responsible for the full amount for that month, regardless of whether the services are used for the entire month.

8.2 Annual or Longer-Term Billing Cycle:

  • Users who sign up for web hosting services on an annual or longer-term basis are entitled to a 30-day money-back guarantee. If a user is not satisfied with the service within the first 30 days, they may request a refund. The refund will be processed minus any credit card processing fees already incurred by Patriot Digital Services, LLC.

8.3 Requesting a Refund:

  • To request a refund, users must submit a request through the my.patriothosting.io portal within 30 days of the service activation date. Refund requests submitted after the 30-day period will not be eligible for a refund.

8.4 Non-Refundable Services:

  • Certain services and fees are non-refundable, including but not limited to:
    • Domain registration fees
    • SSL certificate fees
    • Setup fees
    • Any add-on services or custom work provided during the billing cycle

8.5 Processing Refunds:

  • Refunds will be processed within 10 business days of the approval of the refund request. Refunds will be issued to the original payment method used at the time of purchase.

8.6 Account Termination:

  • If a user terminates their account before the end of the billing cycle, no refunds will be provided for the remaining period of the cycle. Users on an annual or longer-term billing cycle will not receive a prorated refund for the remaining months after the 30-day money-back guarantee period has passed.

8.7 Credit Card Processing Fees:

  • For users eligible for a refund under the 30-day money-back guarantee, any credit card processing fees incurred by Patriot Digital Services, LLC will be deducted from the refund amount.

8.8 Disputes and Chargebacks:

  • Users are encouraged to contact our support team to resolve any billing disputes before initiating a chargeback with their credit card company. Unauthorized chargebacks may result in the suspension or termination of the user’s account.

9. Intellectual Property Rights

9.1 Ownership of Content:

  • All content created, uploaded, or otherwise made available by users on PatriotHosting.io and Patriot Digital remains the property of the user. Users retain all rights, title, and interest in and to their content, subject to the rights granted to Patriot Digital Services, LLC under these Terms of Service.

9.2 License to Use User Content:

  • By using our services, users grant Patriot Digital Services, LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform user content solely for the purpose of providing and improving our services.

9.3 Patriot Digital Services, LLC Content:

  • All content provided by Patriot Digital Services, LLC, including but not limited to text, graphics, logos, images, and software, is the property of Patriot Digital Services, LLC or its content suppliers and is protected by applicable intellectual property laws. Users are granted a limited, non-exclusive, non-transferable license to access and use this content for their personal or business use in connection with the services.

9.4 Trademarks:

  • Patriot Digital Services, LLC, PatriotHosting.io, Patriot Digital, and related logos, service names, and slogans are trademarks of Patriot Digital Services, LLC. Users are not permitted to use these trademarks without the prior written consent of Patriot Digital Services, LLC. All other trademarks, service marks, and logos used in connection with our services are the property of their respective owners.

9.5 Copyright Infringement:

  • Patriot Digital Services, LLC respects the intellectual property rights of others and expects users to do the same. If a user believes that their copyrighted work has been infringed upon, they should contact our support team with a detailed notice of the alleged infringement, including the following information:

Engaging in any of the activities listed below is strictly prohibited and may result in the suspension or termination of services without notice:

10.1 Illegal Activities:

  • Hosting, distributing, or linking to any material that violates local, national, or international laws. This includes copyrighted content without proper authorization, counterfeit goods, and any form of illegal software.

10.2 Resource Abuse:

  • Engaging in activities that excessively consume server resources, leading to the disruption of services for other users. This includes but is not limited to running resource-intensive scripts, using excessive bandwidth, and initiating large numbers of concurrent connections.

10.3 Adult Content:

  • Hosting, distributing, or linking to pornographic or explicit adult material.

10.4 Gambling:

  • Operating or promoting online gambling activities without proper licensing and authorization.

10.5 Hate Speech and Harassment:

  • Creating, posting, or disseminating content that promotes violence, hatred, or harassment against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.

10.6 Terrorism:
